By accessing or using Art for Grandma, you agree to be bound by these Terms of Service. If you do not agree, you may not use the service.

2. Description of Service

Art for Grandma connects families with volunteer “grandmas” who respond to children’s artwork with recorded video replies. The platform facilitates submission, matching, moderation, and delivery of these interactions.

3. Eligibility

• You must be at least 18 years old to create an account.
• Accounts for children must be created and managed by a parent or legal guardian.
• By using the service, you represent that the information you provide is accurate and complete.
• If you submit content involving a child, you represent that you are the child's parent or legal guardian and have authority to provide such content and consent to its use as described in these Terms and our Privacy Policy.

4. Accounts and Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You agree to notify us promptly of any unauthorized use of your account.

5. Use of the Service

• The service is intended for personal, non-commercial use.
• You agree not to misuse the platform, including attempting to bypass safeguards or moderation systems.
• You may not use the service to transmit harmful, abusive, threatening, illegal, sexually explicit, or otherwise inappropriate content.
• You may not submit content that infringes the intellectual property rights of others.

6. Credits and Payments

• Certain features require the purchase of credits.
• Credits are used to unlock video replies.
• Credits have no cash value, are non-transferable, and may not be redeemed for cash.
• All purchases are final and non-refundable unless required by law.
• We may modify pricing or credit structures at any time with reasonable notice.
• Promotional, referral, or complimentary credits may be modified, revoked, or expire as described in the applicable promotion.

7. Content Ownership and License

• Families retain ownership of artwork and other content they submit.
• Volunteers retain ownership of video responses and other content they create.
• By submitting content, you grant us a limited, non-exclusive license to store, display, process, moderate, and deliver that content as part of the service.
• You represent that you have the right to submit any content you upload.

8. Safety and Moderation

• We may review and moderate content to ensure safety and compliance with our policies.
• We reserve the right to remove content, reject submissions, suspend accounts, terminate participation, or refuse service at our discretion.
• No direct communication between families and grandmas is permitted outside the platform unless explicitly allowed.

9. Volunteer Participation

• Grandmas participate on a voluntary basis and are not employees of ExtraServings, Inc.
• We do not guarantee the availability of any specific grandma.
• We may reassign or rotate participants as needed to maintain service quality.
• Video responses reflect the personal views of individual volunteers and do not necessarily represent the views of ExtraServings, Inc.

10. Privacy

• We improve our products and advertising by using Microsoft Clarity to understand how visitors interact with our website. By using our site, you agree that we and Microsoft may collect and use this data.
• Your use of the service is also governed by our Privacy Policy, which explains in more detail how we and our partners collect and use information.

11. Mailing Addresses and Communications

• The service may require the sharing of a volunteer grandma's mailing address with participating families for the purpose of sending artwork and related materials.
• By participating in the service, you acknowledge and consent to the sharing of such information as necessary to facilitate these interactions.
• You agree to use any mailing address or contact information obtained through the service solely for purposes directly related to participation in Art for Grandma.
• You may not publish, distribute, sell, share, or otherwise use another participant's address or contact information for marketing, solicitation, harassment, or any unrelated purpose.
• We reserve the right to suspend or terminate accounts that misuse participant information.
• We are not responsible for communications, mailings, or interactions that occur outside the scope of the service.

12. Termination

• You may stop using the service at any time.
• We may suspend or terminate your access if you violate these terms or misuse the service.
• Upon termination, your right to use the service will immediately cease.
• Certain provisions of these Terms, including ownership, disclaimers, limitations of liability, and payment obligations, will survive termination.

13. Disclaimers

• The service is provided "as is" without warranties of any kind.
• We do not guarantee uninterrupted or error-free operation, or that responses will meet specific expectations.
• We do not guarantee that any artwork submission will receive a response. Responses depend on volunteer availability, successful mail delivery, moderation review, and other factors beyond our control.
• We are not responsible for lost, delayed, damaged, misdirected, or stolen mail or packages.
• We are not responsible for the actions, statements, opinions, or conduct of families, volunteers, or other users of the service.

14. Limitation of Liability

• To the maximum extent permitted by law, ExtraServings, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.
• To the maximum extent permitted by law, our total liability for any claim relating to the service shall not exceed the greater of (a) the amount you paid to us during the twelve months preceding the event giving rise to the claim, or (b) $100 USD.

15. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the service after changes become effective constitutes acceptance of the updated terms.
